Please be patient as our customer service department reviews your application to respond my mail with either an approval or disapproval notice. All approvals will receive a Return Authorization number which must be present on the outside of a returned package to be accepted on site with 25% of the plant cost of the dead plants for return delivery shipping (Minimum $20.00). The order form / shipping label is attached to every package and must be retained for your records, and to verify your order upon arrival-replacements will not be made without the evidence of your order form receipt. Guarantee expires in one growing season. Guarantee is void, if plants are not listed in our web-catalog, if the plants are returned with green bark, live roots or sprouts below the graft. Guarantee is void on potted plants; or any plants shipped outside the recommended zones. Replacements will not be made on discounted plant prices or sale prices. If customer authorizes shipment during below freezing temperatures, then guarantee is void. (See U.S.D.A Zone Map) Even though TyTy offers a one growing season guarantee that plants will grow, TyTy under no circumstances implies or expresses any warranty as to the production of the plants sold. Most plants may not produce fruit or flowers as a result of customer growing practices, inadequate pollination, unsuitable soil types, and regional climate variations. ShippingAll deciduous plants are shipped bare root, unless special arrangements have been made prior to shipping. Container grown deciduous plants are removed from the pots with most of the soil removed and shipped, are bare root. All plant roots are treated with a moisture gel, 'Terrasorb,' and carefully packaged for delivery. Shipping charges are 25% (15% postage & 10% packaging) of the total order, unless you request plants to be shipped in the containers, which will include additional shipping cost. We will not, under any circumstances, refund customer's shipping to return plants to the Nursery. Shipping of dormant plants and trees from TyTy Nursery normally begins Dec 15th every year as explained on our order form and every page of the website, however, some evergreens, herbaceous plants and bulbs can sometimes be shipped in November. Other plants such as Jujube, Quince and bearing size trees come to us from California where dormancy comes later and are shipped to you in January or February as they become available. Worry not in Northern states that the trees arrive in freezing weather, because dormant trees do not go into shock, but trees with leaves can undergo damage if planted at the improper season. If you order from a Northern state, we are happy to reschedule your Fall shipment for the Spring, if you prefer. Fruit trees do not grow above ground normally during the Winter except for the roots underground, so that as long as your trees are planted before Spring leaf-out, the trees will be OK., and TyTy Nursery guarantees your trees livability for the first year. The U.S. Department of Agriculture and the State of Georgia enacted laws stating that woody trees be shipped only when dormant, and the dormancy season is unpredictable determined by the weather. Please do not request TyTy Nursery to ship plants before dormant, since it is improper to do so. In order to conserve shipping costs, TyTy Nursery ships your whole order at one time. Receiving and AcceptanceNursery stock is perishable. All shipments should be immediately and carefully unpacked and inspected on arrival and then placed in proper storage. Any problems with the condition or quality or quantity of goods received should be brought to our attention immediately. In the rare event that you should receive a package from one of our carriers (USPS, DHL, UPS, etc.) that is obviously damaged in delivery, please report to the carrier the damaged package and refuse delivery, then call us to inform us of the problem, and we will ship you a replacement order. Suggested OrderOur suggested order requirement is $60 plus shipping, which is 25% of the total order. Our minimum charge for return shipping on replacements items is $20.00. These terms and conditions of sale may not be changed or amended except by written agreement signed by an employer of TyTy Nursery. By acceptance of the nursery stock, the buyer acknowledges that the limitations and disclaimers herein described are the conditions of sale, and that they constitute the entire agreement between buyer and seller Cancellations/RefundsCancellations for orders placed with TyTy Nursery are not accepted, because TyTy Nursery reserves and holds the ordered plants for the customer when the order is placed. Refunds are available if plants are ordered on the TyTy Nursery website credit card orders, and if these plants are not available to seasonally ship as a complete order. When credit card orders are placed on the TyTy website to prohibited quarantined states, TyTy will refund these orders. TyTy will also refund orders placed for citrus plants in all states other than the State of Georgia if the customer requests it. If our shipper UPS, damages plants in shipment, the customer should promptly file a complaint with UPS, who in turn, will reimburse TyTy for the shipment to be replaced. Plants are healthy and guaranteed to grow and sold by TyTy, because all plants that TyTy grows or purchases for resale are inspected before shipment by the Department of Agriculture and are certified to be healthy. If the plants do not grow after 1 year of planting, the Nursery at TyTy offers a free plant replacement, if picked up at the nursery at the proper season with your replacement application, or the plants may be shipped to the customer upon mailing the replacement application to P.O. Box 130 Ty Ty, GA 31795. Returns for ReplacementsOur nursery stock cannot be returned without the express written permission of TyTy Nursery. In all cases goods cannot be returned after they have been accepted, processed, improperly stored, planted, or otherwise treated, modified or used in any way. Before returning dead plants for replacement, the following season, customer must fill out the RA (Return Authorization) application on the order form and mail it to us so we can review it. The RA application can only be returned to TyTy Nursery, postmarked by mail, to P.O. Box 130, TyTy, GA 31795 in the period Sept 15, 2008 until Oct 31, 2008, so that each plant is given a proper and fair chance for survival and growth. Within 30 days after TyTy receives and evaluates your RA application, TyTy will mail an RA number to you which you should write the RA number on the label of the box that you return the dead plants along with 25% of the plant cost (minimum $20.00) to cover the shipping cost for UPS to return your replacement plant. The plants returned must be returned complete, not shredded, separated roots or in broken pieces, so that we can analyze the cause of the plant death and minimize future losses. If the RA application is approved and the plant return procedure is properly followed, we will begin shipping plant replacements on Dec 15, 2008. Windmill Palm Trees under 4-5 feet are not guaranteed. PruningMost deciduous fruit trees, and all pecan trees are pruned, free of charge, prior to shipping. Texas A&M recommends 1/3 pruning of trees. Other trees, shrubs, bulbs, perennials, etc. may be pruned as deemed necessary by the shipping manager, to facilitate the most efficient method of delivery and to insure the most favorable survivability.
